Terms and Conditions of Use

The information presented on the website www.evplug.ro and in the EVPlug mobile application is the property of S.C. EV PLUG S.R.L., hereinafter referred to as EVPlug, with its registered office in Bucharest, Sector 5, Strada Barlea no. 5-13, registered with the Trade Register under no. J40/2578/2016, having VAT number RO35691200.

These terms and conditions of use apply to your use of our website and mobile application, including all content, features, functionalities, and services offered through them. Please read these terms carefully before using the website or app to ensure you understand our data privacy practices as well as your rights and obligations as a user.

The following definitions apply throughout this document:
- EVPlug website: the official EVPlug web page providing information about our products and services;
- EVPlug mobile app: the mobile application designed for electric vehicle (EV) owners to access charging services;
- Electric Vehicle Charging Station (EVSE): the equipment used to provide electric vehicle charging;
- EVSE Owner: a legal entity that owns an EV charging station and has a service agreement with EVPlug to offer charging via the mobile app;
- User: the recipient of the EV charging service;
- User Account: login credentials used to access the EVPlug app;
- eWallet: balance available to charge the electric vehicle;
- Personal Account: allows individuals to charge an EV using the Personal eWallet, with invoices issued to individuals;
- Business Account: allows corporate users to charge an EV using the Business eWallet, with invoices issued to legal entities;
- Fee / Charge: the amount in RON set by the EVSE Owner for using the equipment, parking, and charging services;
- Service Fee: a fixed fee charged at the beginning of the charging session, defined by the EVSE Owner;
- Parking Fee: hourly parking cost, as set by the EVSE Owner;
- Charging Fee: cost per unit of energy (kWh equivalent) delivered to the EV;
- Total Service Cost: calculated as Service Fee + (Parking Fee × number of hours) + (Charging Fee × number of charging units).

To access EV charging, users must create an account in the EVPlug app. The data provided will be used solely to deliver the service, issue invoices, and process payments. With a single user account, you can charge for both personal (via Personal Account) and company use (via Business Account). Each eWallet is separate, and balances cannot be transferred between wallets.
Adding Credit:
To start a charging session, a minimum top-up of 50 RON is required using a bank card or Google Pay / Apple Pay. Invoices are issued according to account type (individual or legal entity).
Starting a Charging Session:
Choose the account type (Personal or Business), then scan the QR code or enter the code for the desired connector. Charging fees (Service Fee, Parking Fee, Charging Fee) will be displayed for confirmation. If you accept, press "Start Charging". The session will end before your wallet balance reaches zero or turns negative.
Service Delivery:
Charging is delivered at the EV station, and session time is calculated from start to stop.
Returns:
Energy delivered cannot be returned, even if the vehicle supports V2X technologies.
Wallet Transfers:
No funds can be transferred between Personal and Business wallets.
Refund of Unused Balances:
Refunds may be requested by the user and will be processed by EVPlug. The timeline depends on the user's bank. If a Business Account holder changes, unused funds must be refunded.

Stations listed in EVPlug belong to third-party operators under service agreements with EVPlug. Each station has its own access schedule and pricing. By continuing use, you agree to:
-the fees and charges set by station owners;
-parking regulations for stations on private property;
-local rules for public domain installations;
-using equipment only for its intended purpose, in line with provided guidelines.

The content presented describes our products and services. EVPlug does not guarantee:
-proper functionality or uninterrupted operation of charging equipment;
-damages resulting from station use;
-losses caused by service unavailability;
-uninterrupted access to the site or app;
-protection against malware or technical faults.
EVPlug cannot be held liable for direct or indirect damages resulting from use of the website or app.

All content is protected under EVPlug's copyright. No content may be copied, altered, or reproduced without EVPlug’s written permission. Unauthorized actions, including damage, alteration, defamation, or harassment, are strictly prohibited. EVPlug uses technical and organizational security measures to protect controlled data against manipulation, loss, or unauthorized access.

The purpose of the website and app content is to help users identify and order desired products. While EVPlug strives to provide accurate information, occasional errors may occur.

Protecting your personal data is a top priority. All data collected via the site or app is processed in accordance with Romanian laws. The site and app may include links to external websites; EVPlug is not responsible for third-party content. We will protect your data according to our Privacy Policy and these Terms.

In compliance with EU Regulation 2016/679 (GDPR), EVPlug processes your personal data securely and only for specified purposes. For full details on how we process your data and your rights, please consult the linked information. We also provide the necessary information under Articles 13 and 14 of the GDPR. EVPlug requires your explicit consent to contact you for updates, exclusive content, or membership benefits via email or messaging.

Your personal data will be used in accordance with current legislation for marketing analysis, database administration, customer support, and informing you about our products and services. Your data will not be disclosed to third parties or transferred abroad.

As a user/visitor, you must:
-provide accurate and complete registration information;
-update this information as needed.
You must also avoid:
-posting harmful software or viruses;
-sharing copyrighted material without permission;
-posting offensive, defamatory, or illegal content;
-sharing content that violates applicable laws.
Failure to comply may result in data removal and legal action. By registering in the mobile app, you agree to these Terms and Conditions.

By submitting personal data, you expressly agree to:
-processing for commercial purposes (sales and services);
-market research;
-receiving marketing and promotional materials;
-receiving responses to inquiries or complaints;
-any other legal and permitted activities.
EVPlug will keep your data confidential and will not share it with third parties.

Under GDPR and Romanian Law 677/2001, you have the right to access, modify, block, delete, or anonymize your personal data. Requests must be signed and sent to: Str. Barlea 5-13, Sector 5, Bucharest, Postal Code 052073, Romania.
You can also request:
-confirmation of whether your data is being processed;
-to stop processing your data;
-data correction or deletion.

Note: Everyone has the right to object to the processing of their data for legitimate reasons. This right may be limited for legally mandatory processing (e.g., fiscal, police, or justice systems). Everyone also has the right to object, free of charge and without justification, to the use of their data for direct marketing purposes.
